ISSUE
Should City Council approve an extension of the existing Metro Area Communications Commission (MACC) franchise agreement with Comcast through June 30, 2015?
STAFF RECOMMENDATION / ACTION REQUEST
Staff recommends approving the resolution to extend the current Comcast cable franchise agreement through June 20, 2015 to allow for the Comcast and MACC to hopefully complete their current negotiations for a new franchise agreement.
KEY FACTS AND INFORMATION SUMMARY
The City of Tigard is a member of MACC with other regional jurisdictions which includes Washington County, Banks, Beaverton, Cornelius, Durham, Forest Grove, Gaston, King City, Lake Oswego, North Plains, Rivergrove, Hillsboro, West Linn, and Tualatin. MACC administers the cable franchise agreements for Comcast and Frontier for the MACC member jurisdictions.

The current MACC franchise agreement with Comcast signed in 1999 expired January 31, 2013. MACC jurisdictions extended the Comcast franchise agreement through December 31, 2014 to allow for Comcast and MACC to continue to negotiate a new franchise agreement.

MACC and Comcast have agreed in principle on many of the issues where they were far apart earlier in the year (although nothing is final until all topics are resolved), and MACC believes a new franchise agreement should be completed by June 30th based on current negotiations.
OTHER ALTERNATIVES
Not approve the Comcast cable franchise extension resolution which could lead to denying Comcast the right to use the ROW.

On January 14th, 2014 City Council approved Resolution 14-04 to extend the Comcast cable franchise agreement through December 31, 2014.

Additional Fiscal Notes:
The fiscal impact would be positive on the MACC jurisdictions if a new franchise agreement could be agreed to by MACC and Comcast which would avoid the need to spend additional money on the formal process. Currently MACC has set aside a portion of the cable franchise fees collected to pay for the formal process.
